Pregnant worker fired for 'bye bye' comment files lawsuit

Pregnant worker fired for 'bye bye' comment files lawsuit

A worker, fired for saying "bye bye" to a guest on the telephone, filed a pregnancy discrimination lawsuit in Las Vegas this week. The ex-Cosmopolitan Resort and Casino employee says she was harassed and terminated for being pregnant.
Melodee Megia, 37, (in this photo) once worked at the prestigious four-star hotel in Sin City as a sales representative. Her job focused on answering telephone call from guests requesting room service.
Citing a story from the Las Vegas Review Journal, the former worker said that she was fired by the Cosmopolitan in September for violating the company's telephone protocol. Instead of saying, "goodbye," she said "bye bye" to a guest. She was eight-months pregnant at the time.

Months later, she hired a lawyer because she believes her termination was based on her pregnancy. Moreover, she claims to have been harassed and verbally abused when her supervisors learned she was expecting a child.
As a result, the lavish resort is named in a lawsuit filed in Clark County. The complaint alleges Megia was "wrongfully" terminated and was the victim on ongoing abuse because she was pregnant.
The 19-page document read:
"The stated reason for (Megia's) termination was that she said 'bye bye' instead of 'good bye' on the telephone to a room service customer. In fact, this was merely a pretext as (she) has been subject to harassing conduct."
The LVRJ writer said:
"Megia claims a supervisor regularly criticized her for being pregnant, and on another occasion told a co-worker, 'This is what happens when you have sex.'"
She also says a supervisor instructed her to deliver a "pleasure packet" of condoms to a guest's room and said, "Isn't it too late for that? You should have thought about it before getting knocked up."
The other part of the lawsuit against the Cosmopolitan alleges that the fired worker and others were not paid for uniform changes. Additionally, the time-keeping system allegedly shortened their work hours. This complaint is part of a class-action lawsuit against the hotel and casino operator.
Is it discrimination to fire a worker for saying "bye bye" to a guest?
